Supreme Court grants interim bail to SP leader Azam Khan

The Supreme Court on Thursday allowed break bail to Samajwadi Party pioneer Azam Khan in a land-get case.

A Bench drove by Justice LN Rao — which had on May 17 held its decision in the wake of hearing senior guidance Kapil Sibal for Khan and Additional Solicitor General SV Raju, addressing the Uttar Pradesh Government — practiced its power under Article 142 of the Constitution to deliver Khan.

It requested that Khan document a supplication for standard bail under the watchful eye of the skillful court in about fourteen days.

The Interim bail given to him will go on until the ordinary bail supplication was chosen, it said.

The Uttar Pradesh Government had gone against Khan’s supplication, claiming he was a land grabber and an ongoing guilty party as different objections were documented against him even as Sibal discredited the charges.

The top court had on May 11 asked the Uttar Pradesh Government to answer Khan’s bail supplication for the situation. “What is this? Why not let HIM go. He has been in prison for a long time. A couple of cases are OK however it can’t be in 89 cases. At the point when he gets bail, he is again shipped off prison for another matter. You document an answer,” the Bench drove by Justice LN Rao had told the UP Government counsel.

“This chain will go on as and when Khan is delivered on bail in one matter, get him in one more FIR and keep him in the slammer,” the Bench, which likewise included Justice BR Gavai, had noted.

Communicating disappointment over exorbitant deferral in concluding Khan’s bail request in a land snatch case by the Allahabad High Court, the Supreme Court had on May 6 named it as tragedy of equity. Khan has got rescue in 86 of 87 cases, it had noted.

The Allahabad High Court had on May 5 saved its structure on his bail application for a situation of snatching foe property for his Mohammad Ali Jauhar University project. The high court had on December 4, 2021 saved its choice. Khan – who is by and by stopped in Sitapur prison regarding various cases, including that of land getting, held up against him in Rampur – was in February denied break bail by the top court crusading in the Uttar Pradesh Assembly races.

A FIR was held up against Khan and others for purportedly getting adversary property and misusing public cash of more than Rs 100 crore.

The FIR was stopped at police headquarters Azem Nagar in Rampur under the IPC and the Prevention of Damage to Public Property Act.

It was claimed that during allotment one Imamuddin Qureshi went to Pakistan and his territory was recorded as adversary property, yet Khan in agreement with others got the 13.842-hectare plot.
